Please note that use of the California Vintage Limited (hereafter referred to as CV) website is subject to the following terms and conditions of use. If you do not agree with any of these terms and conditions, do not access or otherwise use this CV site or any information or materials contained on the site. Your use of the CV site shall be deemed your agreement to abide by each of the terms set forth below. CV may update these terms and conditions from time to time with or without notice to you. Your continued use of the CV site indicates acceptance of any modifications to these terms and conditions of use.

Sale of Alcoholic Beverages

CV does not sell alcohol to persons under the age of 18. By using this site you swear and affirm that you are over the age of 18. CV makes every effort to ensure that alcoholic beverages are not delivered to anyone who is under the age of 18. By using this site you are acknowledging that the person receiving a shipment of alcoholic beverages from CV is over the age of 18. You also agree that any alcohol purchased from CV is intended for personal consumption and not for resale. If you do not agree with these terms and conditions of use please do not use this site. If you intentionally or unintentionally misrepresent your age in order to provide alcohol to a person under the age of 18, CV will prosecute you fully to the extent allowable by law.

Registration

No registration is required in order to use this website, though a user must create an account prior to completing any purchase. Users are required to provide accurate, complete and up to date information including: name, date of birth, telephone number, email address, delivery address and a password of 5-16 characters in length. CV reserves the right to accept or refuse membership at our discretion. You may not transfer or assign your membership or these benefits.

Termination

CV may terminate your CV account with or without cause at any time effective at its sole discretion without notice, if CV determines, at its discretion, that you have violated these terms and conditions or any applicable law, involves fraud or misuse of this program, or is harmful to our interests or another user. CV ’s failure to insist upon or enforce your strict compliance with these terms and conditions will not constitute a waiver of any of its rights

Modifications to prices or billing terms

CV reserves the right, at any time, to change its prices and billing methods for products or services sold, effective immediately upon posting on the site or by e-mail delivery to you.

No responsibility to sell mispriced products or services

CV shall have the right to refuse or cancel any orders placed for products and/or services listed at an incorrect price, rebate or refund, or containing any other incorrect information or typographical errors. CV shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, CV shall issue a credit to your credit card account in the amount of the charge in a prompt and timely manner.

Delivery

CV shall make every effort to ensure products displayed on the website are in stock. If from time to time products become out of stock, the CV reserves the right offer alternative, substitute products of similar value and style.

All orders are subject to confirmation of final availability and CV reserves the right to reject an order in the event that any of the products or services requested are unavailable. In the event that we are unable to fulfill any of the products or services in your order we will notify you by phone or email before your requested delivery date.

Breakage

The customer is requested to examine the goods immediately upon delivery for any deficiencies and/or damages. Claims (if any) must be lodged to us +852-2891-8181 at the time of delivery; otherwise we shall have the discretion to refuse your claim after delivery.

Force majeure

CV shall be excused from performance under this terms and conditions if CV is prevented, forbidden or delayed from performing, or omits to perform, any act or requirement under this terms of service by reason of: (a) any provision of any present or future law or regulation or order of Hong Kong, (b) any act or omission of a third party, or (c) any act of god, emergency condition, war, computer or telecommunications failure or other circumstance beyond the control of CV.

Information Collection and Use

CV is the sole owner of the information collected on this site. We will not sell, share, or rent this information to others in any way that varies from what is disclosed in this statement. CV collects information from our users at several different areas on our site.

You may receive information regarding new features, services and special offers we think you will find valuable. We may also share information with carefully selected business partners.
